1. Acceptance of Terms
By creating an account or using Guardyn, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and Guardyn.
You must be at least 13 years old to use Guardyn. If you are under 18, you must have permission from a parent or legal guardian.
2. Service Description
Guardyn is a privacy-focused end-to-end encrypted messaging platform. The service includes:
- 1-on-1 messaging with end-to-end encryption (X3DH + Double Ratchet)
- Group chat with OpenMLS encryption (up to 1000 members)
- Media sharing (photos, videos, files up to 10GB)
- Voice and video calls with SFrame E2EE
- Live broadcasting with E2EE streams
- Self-hosted deployment options (Community Edition)
- Enterprise features (LDAP, SAML, compliance tools - Enterprise Edition)
Guardyn is currently in MVP/PoC phase. Features may change, and service availability is not guaranteed during development.
3. User Registration
To use Guardyn, you must create an account by providing:
- Valid email address or phone number
- Username (must be unique)
- Strong password
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
You may not create multiple accounts or use automated means to create accounts.
4. Privacy and Security
Guardyn implements end-to-end encryption for all messages and media. This means:
- Only you and your intended recipients can read your messages
- Guardyn cannot access the content of your encrypted messages
- Your encryption keys are stored only on your devices

Security Notice: While we use industry-standard encryption, no method of transmission over the internet is 100% secure.
You use Guardyn at your own risk.
5. User Conduct
You agree NOT to use Guardyn to:
- Violate any applicable laws or regulations
- Harass, threaten, or harm others
- Distribute spam or unsolicited messages
- Share malware, viruses, or malicious code
- Impersonate others or misrepresent your identity
- Infringe on intellectual property rights
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the service
- Use automated scripts or bots without permission
Violation of these rules may result in immediate account termination.
6. User Content
You retain ownership of all content you create and share through Guardyn. By using our service, you grant us:
- A license to store and transmit your encrypted content
- The right to back up your data for service reliability
- Permission to use anonymized, aggregated data for service improvement
You are responsible for the content you share. Guardyn cannot monitor encrypted content, but we will respond to valid legal requests
and may take action based on metadata or reported violations.
7. Intellectual Property
Guardyn uses a dual licensing model:
Community Edition (Apache-2.0)
Fully open source and free forever:
- Client applications (iOS, Android, Desktop, Web)
- Server core (auth, messaging, presence, media services)
- Cryptographic libraries (X3DH, Double Ratchet, OpenMLS)
- Infrastructure configs (Kubernetes, Terraform)
- CI/CD pipelines (GitHub Actions, reproducible builds)
Enterprise Edition (BSL 1.1 → Apache-2.0 in 4 years)
Advanced enterprise features:
- LDAP/SAML integration
- Admin console (web-based management)
- Compliance tools (audit logs, e-discovery)
- Advanced analytics (usage metrics, dashboards)
- Policy-based retention (GDPR, HIPAA compliance)
- HSM integration (FIPS 140-2 Level 3)

The Guardyn name, logo, and branding are trademarks and may not be used without permission.

8. Termination
You may delete your account at any time through the app settings. Upon deletion:
- Your account will be permanently removed
- Your messages will be deleted from our servers
- Some metadata may be retained for legal compliance
We reserve the right to terminate or suspend your account if you violate these terms, without prior notice.
10. Limitation of Liability
To the maximum extent permitted by law, Guardyn and its developers shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, profits, or business opportunities
- Service interruptions or data breaches
- Actions of other users
Our total liability shall not exceed $100 USD or the amount you paid us (whichever is less).
11. Indemnification
You agree to indemnify and hold harmless Guardyn and its developers from any claims, damages, or expenses arising from:
- Your use of the service
- Violation of these terms
- Infringement of third-party rights
- Your content shared through Guardyn
12. Changes to Terms
We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last Updated" date.
Continued use of Guardyn after changes constitutes acceptance of the new terms. If you disagree with changes,
please stop using the service and delete your account.
